Paul J. Reilly is one of the nation's leading trademark, advertising, and brand protection lawyers. Paul’s experience unquestionably informs his distinguished litigation practice. He has represented clients in federal intellectual property disputes across the United States and litigated hundreds of oppositions and cancellation proceedings before the Trademark Trial and Appeal Board and foreign trademark offices. He has designed and led comprehensive brand enforcement strategies, handled unfair competition matters, and false competitive advertising disputes, including, before the National Advertising Division (“NAD”).

Having spent decades immersed in how brands evolve and compete in the marketplace, Paul serves as a critical trusted advisor, offering both legal insight and business practicality on the development, protection, and global management of brands. He leads worldwide trademark portfolio strategy, helping clients maintain brand consistency while navigating international trademark registration, product messaging, and the legal risks that accompany global expansion.  Importantly, Paul elevates his practice to the benefit of his clients through mentoring lawyers, partners, associates, trademark specialists, paralegals and staff who provide leverage and support in managing businesses’ valuable brands, goodwill and reputations nationally and internationally.

Paul co-chairs the Baker Botts Branding, Advertising, and Copyright (“BAC”) practice group, a cohesive team of lawyers and professional who partner shoulder to shoulder with clients through a myriad of legal issues facing business today. Mr. Reilly has extensive experience across a broad range of industries such as energy, food and beverage, computers and electronics, telecommunications products and services, toys, footwear, hotel services, financial services, credit card services, jewelry, magazines, hospitality, entertainment, construction, clothing, restaurant services, hair care products, cosmetics, shoes and other services and product industries.

Representations have included:

  • Representing Fortune 500 food and beverage companies in trademark, trade dress, design patent, utility patent, unfair competition and copyright litigations, proceedings and enforcement matters
  • Representing major automotive supplier and manufacturing in copyright royalty dispute
  • Representing a medical device manufacturer through a jury trial in the District of Delaware where the jury found its competitor, liable for false advertising and unfair competition, and rejected the competitor's claims of false advertising; the jury awarded $2.2 million in lost profit damages and $10 million in punitive damages
  • Representing costume and party retailer against claims of copyright infringement and unfair competition relating to computer application for inventory and sales management
  • Defending jewelry design firm and retailers against claims of trademark infringement, trade dress infringement and unfair competition and asserting counterclaims for false advertising and unfair competition under federal and Texas state law
  • Representing manufacturer of consumer household utility products in challenge of its performance and ease of use claims regarding its product before the National Arbitration Division ("NAD") of the Better Business Bureau
  • Representing consumer products company before the NAD in challenging competitor's advertising asserting public health claims for its product, and defending challenges of comparative price claims and allegations that its ads were deceptively disparaging
  • Representing significant pharmaceutical company in disputes relating to trademark infringement and false internet advertising
  • Representing long standing toy manufacturer in trademark, trade dress and copyright infringement lawsuits
