Baker Botts Delivers More Than $213 Million Trade Secrets Victory for DXC Technology

Baker Botts secured a significant trade secrets victory for Computer Sciences Corporation, a wholly owned subsidiary of DXC Technology Company, culminating in the collection of more than $213 million after the U.S. Supreme Court declined to review the case.

The result concludes more than seven years of litigation arising from Tata Consultancy Services’ willful and malicious misappropriation of CSC’s trade secrets. CSC alleged that Tata used its proprietary information to develop a competing insurance-policy administration system and secure new business, including a $2.6 billion contract with Transamerica.

CSC engaged Baker Botts to assume the role of lead counsel before discovery. The firm guided the case through extensive factual and technical development, a two-week trial, appellate proceedings before the Fifth Circuit and a petition to the U.S. Supreme Court.

The final recovery includes damages, prejudgment interest, attorneys’ fees and costs. A permanent injunction was also entered, with the Fifth Circuit affirming liability and the damages award while narrowing aspects of the injunction.
