Houston, Texas, March 6, 2025 – Baker Botts recently achieved significant wins, involving several patents, for clients Manticore Fuels and Permian Global, a leading provider of diesel and related fueling solutions to oilfield operators, at the U.S. Patent and Trademark Office (PTAB). 

In July 2022, Fuel Automation Station sent Manticore Fuels and Permian Global letters in which they alleged that their CORE Automated Fueling Solutions infringed three patents of Fuel Automation Station. Weeks later, Fuel Automation Station sued Manticore Fuels and Permian Global for patent infringement in federal court for the Western District of Texas.  In 2023, Baker Botts filed three petitions for inter partes review (IPR) with the Patent Trial and Appeal Board of the Patent Office, and the federal court stayed the patent infringement lawsuit pending the completion of the proceedings at the PTAB.  The PTAB held an oral hearing in the IPRs in December 2024.

On February 26, 2025, the PTAB issued its Final Written Decisions in the IPRs.  In the decisions, the PTAB held that all claims of all three patents asserted by Fuel Automation Station are unpatentable in view of the prior art. On March 6, 2025, the federal court ordered that the patent infringement lawsuit remain stayed pending any appeal by Fuel Automation Station of the PTAB’s decisions.
