HOUSTON, August 12, 2026 – Baker Botts L.L.P., a leading international energy, technology, and life sciences law firm, secured a Ninth Circuit victory for Devas Multimedia Private Ltd. in proceedings to enforce an international arbitral award now worth more than $2 billion against Antrix Corp. Ltd., a corporation wholly owned by India.

In Devas Multimedia Private Ltd. v. Antrix Corp. Ltd., the U.S. Court of Appeals for the Ninth Circuit affirmed the district court’s confirmation of the award, resolving three questions that remained after the U.S. Supreme Court ruled for Devas in 2025. An International Chamber of Commerce tribunal awarded Devas $562.5 million in 2015 after finding that Antrix wrongfully terminated a 2005 agreement to lease S-band satellite spectrum to Devas. With accrued interest, the award is now worth more than $2 billion.

On a question of first impression in the circuit, the panel held that forum non conveniens does not apply to actions to confirm foreign arbitral awards under the New York Convention. It also held that the Foreign Sovereign Immunities Act’s arbitration exception provided subject matter jurisdiction without requiring a connection to U.S. commerce and that exercising personal jurisdiction over Antrix was consistent with the Fifth Amendment.

"This ruling sets an important precedent that will promote US enforcement of awards resulting from agreements to engage in international arbitration,” said Aaron Streett, Supreme Court and Constitutional Law Chair. “The Court correctly rejected various impediments to enforcement that had no basis in the Foreign Sovereign Immunities Act or the New York Convention.”
