Brendan Quigley is a first-chair trial lawyer who represents companies, boards, and executives in high-stakes government litigation and investigations and in commercial disputes. An experienced advocate who has conducted over a dozen trials, a former U.S. government prosecutor in the Southern District of New York, and a U.S. Marine combat veteran, Brendan brings a combination of courtroom skill, prosecutorial insight, and battle-tested judgment to every matter. Described in industry publications as “highly skilled” with a “methodical analytical approach,” (Chambers USA 2026), he combines the courtroom expertise of “a really good advocate” and a “great defense lawyer” (Chambers USA 2025) with “a calm approach to advising clients,” providing “real and practical solutions” (Chambers USA 2026).

Before joining Baker Botts, Brendan served as an Assistant United States Attorney in the Southern District of New York, investigating and prosecuting complex cases in two of the Office's most elite sections: the Securities and Commodities Fraud Unit and the Terrorism and International Narcotics Unit. During his seven years as an AUSA, Brendan gained extensive first-chair trial and appellate experience, trying 12 cases to verdict, including numerous complex, multi-week trials, and briefing and/or arguing 10 appeals before the Second Circuit. This experience gives him critical insight into how federal prosecutors build cases, evaluate evidence, and make charging decisions—insight he now draws on to advise, advocate for, and protect his clients.

Government and Internal Investigations/Enforcement: Brendan's investigations practice focuses on white-collar criminal defense and investigations, securities and commodities enforcement, and False Claims Act investigations and litigation. Having first-chaired over a dozen trials, he has the experience and know-how to fight the government in court, but many of his most rewarding representations have involved helping clients resolve sensitive matters at an early stage, before charges were ever brought, through proactive advocacy and strategic counsel.

Commercial Disputes: Brendan’s trial experience also extends to high-stakes commercial litigation. He represents clients as both plaintiffs and defendants in complex disputes, focusing on matters in the energy, technology, and financial services industries. His recent successes include prevailing at trial in the Delaware Court of Chancery in a dispute among shareholders of a closely held corporation, serving as key member of a team that prevailed in an intercreditor indenture litigation in federal bankruptcy court, and successfully defeating  a securities fraud lawsuit against a fintech company in New York state court.

Earlier in his legal career, Brendan spent a year clerking for the Honorable Joseph F. Bianco, then a U.S. District Judge in the Eastern District of New York, now of the Second Circuit.

Brendan also served as an active-duty combat-arms officer in the U.S. Marine Corps between 2001 and 2005, receiving an honorable discharge as a Marine Captain. During his service, he completed two tours of combat duty in Iraq and learned important lessons about preparation, calmness under pressure, and commitment to mission, which he continues to draw on today.

Experience

White Collar Criminal Defense and Investigations

  • Represented multiple companies in criminal securities fraud and foreign corruption investigations by the DOJ Fraud Section and the U.S. Attorney’s Office for the Southern District of New York, which were resolved without the filing of charges. 
  • Represented Fortune 50 energy company in securing rare post-indictment deferred prosecution agreement from DOJ in Clean Water Act investigation. 
  • Represented U.S. Navy contractor in securing a non-prosecution agreement following DOJ investigation into environmental incident at company facility. 
  • Represented business executive charged with RICO conspiracy, securities fraud and wire fraud in the Southern District of New York.
  • Represented business executive originally charged with money laundering in the Southern District of New York. Client pled to a lesser offense and, despite a 30-37 months’ Guidelines range, received a sentence of only two months.
  • Represented multiple directors, including the Chair of the Audit Committee, of a multinational energy company, in ongoing investigations regarding potential irregularities and alleged misconduct across dozens of its subsidiaries, a U.S. criminal investigation by the DOJ and SEC, and other regulatory scrutiny in the U.S. and India. 
  • Represented business executive charged with securities fraud and wire fraud in the District of New Jersey.
  • Conducted internal investigation for Middle-East based company, concerning potential fraud by counter-party.

Securities and Commodities Enforcement

  •  Represented major fintech company in multi-year SEC investigation, which was ultimately resolved on a non-scienter, no-admit, no-deny basis.
  • Represented former partner at major accounting firm in SEC investigation concerning alleged misrepresentations to Pennsylvania’s Public School Employees’ Retirement System.  Negotiated a favorable settlement with the SEC, allowing client to continue working in the industry.
  • Represented multiple executives at investment banks in connection with investigations by the Securities and Exchange Commission concerning alleged “off-channel” communications.
  • Conducted internal investigations for multiple energy and technology companies, boards, and audit committees in connection with allegations of violations of the securities laws and/or potential bribery or corruption.

False Claims Act Litigation and Investigations

  •  Prevailed on pre-discovery summary judgment motion for defendant in qui tam action alleging improper receipt of Paycheck Protection Program loan.
  • Represented a Fortune 50 company in False Claims Act investigation by the Department of Justice concerning customs enforcement matters. Matter resolved without charges. 
  • Represented military and law enforcement contractor in False Claims Act investigation by the Department of Justice. Matter resolved without charges.
  • Represented pharmaceutical company in False Claims Act investigation by the Department of Justice. Following the investigation, the government declined to intervene, and the qui tam relator voluntarily dismissed the lawsuit.
  • Provided counseling to numerous companies regarding FCA risk and compliance in connection with government grant and loan programs, including as part of various government “clean energy” initiatives.

Commercial Disputes

  • Prevailed on motion to dismiss in the Southern District of New York on behalf of renewable energy company in litigation concerning solar power facility.
  • Represented business executive in dispute in the Delaware Court of Chancery. Prevailed at trial and awarded significant attorneys’ fees.
  • Represented fintech company as plaintiff in fraud and breach of contract case in the New York County Commercial Division.
  • Represented debtor in adversary proceedings concerning complex financial transactions. Prevailed on summary judgment in highly-watched litigation challenging the Debtor’s issuance of priming notes.
  • Represented fintech company in Securities Act claim filed in New York County Supreme Court. Delivered oral argument and was granted dismissal with prejudice.
  • Represented energy company in breach of contract action in the Southern District of New York.
  • Represented energy company in fraud and breach of contract action in the Eastern District of New York.
  • Representing mining company in defamation action in the Eastern District of New York.
  • Representing a global engineering firm in a pending lawsuit under the Anti-Terrorism Act in the District of Columbia

  • Counsel in the district court and the Second Circuit for case involving constitutional challenges to the Sex Offender Registration and Notification Act; conviction affirmed by the Supreme Court of the United States in a 5-3 decision in June 2019 (United States v. Gundy)
