Overview

Having worked as a staff attorney at the Public Utility Commission of Texas (PUCT), Landon now helps energy market participants navigate complex regulatory requirements. He represents electric utilities, generators, and retail electric providers before the PUCT and ERCOT.

Landon has advised on a broad range of wind, solar, and storage transactions--drafting, reviewing, and negotiating interconnection agreements, power purchase agreements, and equity capital contribution agreements.

Additionally, Landon helps generators, oil and gas companies, and crypto-miners structure private use networks and other behind the meter arrangements.

Experience

Electric Utility

  • Represented an electric utility company in multiple fuel surcharge proceedings.
  • Represented an electric utility in a fuel formula and fuel factor update.
  • Lead counsel in an electric rate case where the utility sought a $117M rate increase.
Retail Electric Providers (REPs)
  • Successfully obtained numerous Option 1 and Option 2 REP certificates from the PUCT on behalf of new entrants.
  • Defended a REP against a customer complaint before the PUCT.
  • Guided multiple REPs in establishing regulatory compliance programs.
  • Drafted customer contracts including terms of service and electricity facts labels.
  • Advised on the sale of a REP certificate.
  • Advised energy company in the purchase of an existing REP.

Power Generation Companies (PGCs)

  • Represented multiple PGCs in behind-the-meter transactions with oil and gas companies and cryptominers utilizing both private use networks (PUNs) and private distribution networks.
  • Represented multiple solar developers in negotiating power purchase agreements.
  • Represented a wholesale storage company successfully contesting an illegal tariff change.
  • Represented numerous wind, solar, and wholesale storage project owners in power generation company registrations and renewable energy credit generator certifications.
  • Advised in financing over 4 GW of solar and wind transactions in Arkansas, Colorado Texas, Illinois, Iowa, Kentucky, Missouri, and Oklahoma.
  • Advised on the purchase of a single-cycle gas plant in Harris County, Texas.

Data Centers and Industrial Energy Consumers

  • Advised an industrial customer on the co-location of a 300 MW solar facility and the creation of a PUN.
  • Advised multiple oil and gas companies on the creation of a private distribution network with behind the meter thermal generation.
  • Negotiated PPAs and energy services agreements on behalf of bitcoin miners.
  • Negotiated interconnection agreements on behalf of bitcoin miners.
  • Advised bitcoin mining firms on ERCOT related issues.
