Former Head of FERC's Division of Investigations Joins Baker Botts

HOUSTON, February 12, 2024 – Baker Botts L.L.P., a leading international energy, technology and life sciences law firm, announced today that David Applebaum has joined the firm as a partner in the Energy Litigation practice group in Houston.

Applebaum's practice focuses on energy industry enforcement, compliance, internal investigations, audits, litigation, regulatory, and policy matters. He regularly advises on proposed wholesale and retail energy market transactions to mitigate enforcement risk from the Federal Energy Regulatory Commission (FERC), Commodity Futures Trading Commission (CFTC), North American Electric Reliability Corporation (NERC), state public utility commissions (PUCs), antitrust enforcers, and Regional Transmission Organization (RTO) market monitors. In addition, he successfully represents clients on a broad range of enforcement investigations and surveillance inquiries alleging market manipulation.

Prior to entering private practice, Applebaum was the head of FERC's Division of Investigations, where he managed all aspects of the Division, including decisions on opening, conducting, and resolving investigations, settlements, enforcement actions, trials, and electric reliability inquiries. He also led the Division in coordination efforts with the CFTC on market manipulation investigations. During his government service, he was a member of the Office of Enforcement senior management team and was a key advisor to Commissioners' offices and senior staff on enforcement matters.

“David’s proven track record and reputation in the energy sector, coupled with his outstanding relationships across the industry, will further deepen our market-leading energy enforcement and compliance capabilities,” said Danny David, Managing Partner of Baker Botts. “The unique perspective that David has gained through his senior government regulatory experience and in private practice makes him particularly appealing to clients in the energy industry.”

“We are delighted to welcome David to Baker Botts,” said Bridget Moore, Chair of the firm's Litigation practice. “He is an outstanding lawyer, whose strong relationships and experience will be of particular benefit to a number of our clients, many of whom are at the forefront of the ongoing transformation of the energy sector. We have no doubt he’ll be an excellent addition to our team.”

“I’m thrilled to be joining Baker Botts,” said David Applebaum. “The firm’s energy team has an excellent reputation in the market, and the caliber of their lawyers is second-to-none. I’m excited to begin the next phase of my career being part of such a broad-based energy platform and working alongside an exceptional group of dedicated colleagues who promote a team-oriented approach to client service.”
