Overview

James Williams is an intellectual property litigator who focuses his practice on patent and trade secret issues, as well as copyright, unfair competition, breach of contract, fraud, tortious interference, and other business tort claims that can accompany intellectual property disputes. James is experienced representing both plaintiffs and defendants, including in multi-claim and multi-jurisdictional competitor disputes. James is a registered patent attorney and represents patent owners and petitioners in disputes before the Patent Trial and Appeal Board.

  • Represented an enterprise grade software developer in asserting trade secret misappropriation claims against a competitor that resulted in a $210 million jury award.
  • Represented an oil and gas drilling and technology company in asserting a patent related to horizontal drilling guidance software against a competitor that resulted in a favorable pre-verdict settlement following a jury trial.
  • Represented a cellular base station manufacturer and prepared patent owner preliminary responses to five petitions for inter partes review brought by the client’s licensee that resulted in the PTAB denying institution to three of the petitions and the dispute resolving before the PTAB issued institution decisions for the remaining two petitions.
  • Represented an enterprise network security company in asserting five patents relating to network security hardware and software against a competitor that resulted in a favorable settlement.
  • Represented a core network equipment company in a multi-jurisdictional dispute against a competitor that involved asserting patent infringement and trade secret misappropriation claims and defending against patent infringement and business tort claims.The dispute resulted in a jury verdict of patent infringement for the client, a jury verdict of non-infringement for the patent claims against the client, and a $63 million public settlement of all disputes in favor of the client.
  • Represented a cellular base station manufacturer and multiple cellular carriers in a multi-jurisdictional dispute against a publicly traded non-practicing entity asserting five patents alleged to be standard essential that resulted in the plaintiff dropping four patents and invalidation of the fifth.
  • Represented multiple cellular carriers in a multi-jurisdictional dispute against a publicly traded non-practicing entity asserting two patents alleged to be standard essential that resulted in summary judgment in favor of the client.
  • Represented a handset manufacturer and prepared petitions for inter partes review of two wireless technology patents alleged to be standard essential in parallel litigation against the client that resulted in the PTAB instituting both petitions and a favorable settlement for the client in the parallel litigation.
