Caroline Duncan works on a range of intellectual property matters, with an emphasis on complex patent litigation in the U.S. district courts. Caroline has experience in all the phases of litigation, including involvement with patent jury trials, depositions, infringement and invalidity analysis, claim construction, fact and expert discovery, pre-trial and post-trial motion practice, pre-trial disclosures, and damages. Caroline's litigation experience has involved a wide variety of technologies, including, utility patents for location technology, flight control systems for unmanned aerial vehicles, fleet management software, and programmable thermostats, and design patents for application interfaces.
Caroline also has experience working with the United States Patent and Trademark Office. She challenges patents in inter partes review (IPR) proceedings before the Patent Trial and Appeal Board and has experience drafting and prosecuting patent applications involving a variety of technologies, including telecommunications, medical devices, and software.
In addition to her patent litigation and prosecution practice, Caroline works collaboratively with clients to clear, manage and enforce global intellectual property portfolios. Caroline has experience with branding, advertising and copyright matters, including brand protection strategy and international trademark counseling, clearance, prosecution, enforcement, licensing and litigation. Clients in diverse industries, including technology, media, entertainment, fashion, consumer products and food and beverage, regularly work with Caroline in complex commercial disputes in federal court and contested matters before the Trademark Trial and Appeal Board.
Caroline also maintains an active pro bono docket, which includes assisting pro bono clients in addressing IP issues and preparing trademark and patent applications.
During law school, Caroline served as the president of the Intellectual Property Law Society and was inducted to the Bench and Bar Legal Honor Society.
Prior to law school, Caroline earned a degree in biomedical engineering from The University of Texas.
