Baker Botts’ IP Department Gets Top Rankings in LexMachina’s Patent Litigation Report 2024
HOUSTON, February 13, 2024 – Baker Botts L.L.P., a leading international energy, technology and life sciences law firm, announced today that its Intellectual Property Department’s Patent Litigation team obtained top rankings in LexMachina’s Patent Litigation Report 2024.
Patent Trial and Appeal Board Practice: The report shows that the number of trials the Baker Botts team appeared in before the Patent Trial and Appeal Board (PTAB) was first among all general practice firms between 2021-2023, for a total of 217 PTAB trials. Overall, Baker Botts has handled over 700 PTAB trials with an impressive win rate, per Lex Machina’s database. Since 2019, for Petitioners, the firm has a 71% institution rate (compared with the industry rate of 61%). For Petitioners at Final Written Decision (FWD), meaning no claims survive, it has a 79% win rate, compared with the industry win rate of 67%. Finally, For Patent Owners, the firm’s win rate (meaning all claims survive) is 68%, compared to the industry rate of 56%.
District Court Litigation Practice: LexMachina’s report also ranked the Baker Botts patent litigation practice as one of the most active firms in defensive cases from 2021-2023 with a total of 131 cases, across all the major venues for patent litigation.
