Overview

Michael Yuffee, Global Projects partner and firmwide Section Chair-Energy Regulatory, has extensive experience representing clients in energy and commodity-related regulatory proceedings, investigation, and transactional matters before the Federal Energy Regulatory Commission (FERC) and the Commodity Futures Trading Commission (CFTC). He is experienced in the regulatory facets of both the physical and financial wholesale power, natural gas, oil, and products markets, including the formation and redesign of wholesale energy markets, transmission and transportation access, capacity market development, interconnection issues, electric transmission, natural gas and oil pipeline rate proceedings, and general administrative and civil litigation matters. He regularly represents wholesale market participants, energy traders and marketers, commodities traders, financial institutions, wholesale power suppliers, and integrated energy companies with the development of regulatory compliance programs as well as represents clients in both public and non-public investigations, audits, and enforcement actions before the FERC, CFTC, and other agencies.

Michael also advises clients in the complex regulatory aspects of structured physical and financial energy transactions, project development transactions, mergers and acquisitions, and wholesale power and natural gas transactions.

Michael was previously the head of the FERC regulatory practice at a leading international law firm. Prior to entering private practice, he was an attorney-advisor in FERC's Office of Administrative Law Judges, where he assisted in all aspects of electricity and natural gas rate proceedings, mergers, and utility restructuring.

  • Represent Hollow Road Solar in filing a Petition for Declaratory Order concerning the application of PJM’s then-effective capacity market Minimum Offer Price Rule
  • Counsel to Cube Yadkin Generation LLC in filing of complaint against PJM related to dynamically scheduling Tariff provisions

Generation Interconnection Issues

  • Counsel clients with respect to FERC’s Generation Interconnection Queue Reform NOPR
  • Represent various renewables developers in filing comments/protests to PJM’s generation interconnection queue reform tariff filing
  • Represent renewables developer in various generation interconnection queue issues across the country in PJM, ISO- New England, New York ISO, MISO, SPP and the de-centralized markets in the southwest and southeast
  • Represent solar developer in Tri-State’s generation interconnection queue reform process
  • Represent offshore wind developer in various PJM-related generation interconnection issues
  • Represented solar developer in dispute before FERC related to PJM’s generation interconnection rules and application of mitigation under its capacity market construct
  • Represent wind developer with regulatory issues associated with a repower of its wind facility and associated interconnection issues

  • Represent natural gas marketer in FERC investigation into Winter Storm Uri effect on Midcontinent and Texas gas markets

  • Represent international bank in FERC audit of its power and natural gas regulatory compliance

  • Counsel to generation owner in negotiating settlement of a TRE NERC audit and investigation
  • Represented a generator owner/operator in an investigation of potential CIP violations (Reliability First RE)
  • Represented a TO in a self-report and settlement of potential standards violations including CIP, Communication, outage coordination (WECC)
  • Represented a generator owner/operator in a settlement of NERC standards violations related to outage coordination and certain operational standards (WECC)
  • Represented marketer/trading entity in FERC compliance audit related to its power and natural gas trading activities
