The European Commission adopted updated Standard Contractual Clauses for data transfers between EU and non-EU countries, providing much needed predictability and guidance after the Schrems II decision invalidated the EU-US Privacy Shield.

2. SCOTUS 'Van Buren' Ruling Cracks down on Employee Policing

Employers now have one less legal mechanism for enforcing employee computer usage, but companies may still rely on state-level trade secret statutes and common law.

3. Data Privacy is increasingly shaping M&A Deal Making

The combination of rising cybercrime and an increasingly complex legal framework in the U.S. and abroad is forcing companies to pay more attention to privacy and cybersecurity in M&A.

4. Masks Off: Navigating the COVID-19 Vaccine Era

As vaccination rates rise and hybrid/remote working practices become more commonplace, companies should remain vigilant about data security practices and pay close attention to how they collect personnel information, such as employee vaccination status. 

5. Ransomware is a board level issue

With enterprise ransomware attacks on the rise, boards must stay educated about and remain actively involved in cybersecurity risk management by prioritizing preventative measures and remediation efforts for ransomware attacks.
