Baker Botts is delighted to participate in the International Bar Association virtual conference on 23 November 2020. 

Baker Botts Partner, Catriona Hatton will act as Chair, alongside Martin Brodey, DORDA Rechtsanwalte GmbH, during the Foreign Investment Review - Rapid Regime Growth session from 10am - 11am (GMT).  

The session will look at how the foreign investment review is increasingly taking centre stage alongside merger review in global deals. Previously a rare and minor concern in international transactions, these regulatory requirements are today increasing in number. Established regimes are also being beefed up and applied more strictly and to a broader range of investments beyond traditionally sensitive sectors such as defence. These rules can present even greater challenges than multi-jurisdictional merger review and the assessment is often subject to considerable political discretion. This not only affects deal timelines, but makes outcomes less predictable than they were in the past.
