European Commission Dawn Raids: Practical Tips and Guidance

External Article

Competition law enforcement in the EU continues to be a major issue for businesses, whether based in the EU, U.S. or elsewhere. Enforcement by the European Commission and national competition authorities often begins with unannounced inspections on companies’ premises in the EU – otherwise known as “dawn raids." Dawn raids by the European Commission and by national authorities are invariably stressful situations which require fast and cool-headed reactions from those on the site of an inspection, and from those leading the company’s legal strategy in response to the investigation. Certain decisions taken during a dawn raid inspection can have a direct impact – either helpful or damaging – on the eventual outcome of any subsequent antitrust investigation.

Preparation by any personnel who will be involved in a dawn raid – either through direct exposure to an inspection team, or through management of legal and other corporate responses to the inspection – is essential. Our dawn raid “best practices” guide is based on the experience of the lawyers in our Antitrust Practice, who have assisted clients in dawn raid investigations by both the European Commission and national competition authorities.

We would be happy to discuss with you the preparation of a more tailored set of guidelines which take into account the specific circumstances of your company and invite you to contact any of the lawyers listed below.
