  • Briefed, argued, and won motion to dismiss state natural resource damages (NRD) suit on behalf of manufacturing client.
  • Representation of an oil and gas company in a federal district court trial brought under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) to recover cleanup costs from the federal government as a potentially responsible party (PRP), including winning award for client at trial.
  • Representation of an oil and gas company in a CERCLA appeal before U.S. Court of Appeals for the Fifth Circuit.
  • Ongoing representation of numerous industry clients at various Superfund and other cleanup sites in federal court, including federal courts in Texas, New Jersey, and Connecticut.
  • Ongoing representation of numerous industry clients in complex alternative allocation processes at multiple large sediment Superfund Sites.

  • Representation of an oil and gas company in a contract claim against the federal government to recover cleanup costs.

  • Representation of energy companies intervening in rulemaking challenges, including challenges related to federal coal combustion residuals (“CCR”) rules.
  • Representation of numerous energy companies on CCR Part A/Part B applications.
  • Counseling numerous energy companies on issues related to compliance with various waste regulations under the Resource Conservation and Recovery Act (RCRA), including regulations related to CCR.
  • Representing companies completing state and federal cleanups.
  • Counseling various companies on compliance with current and prospective state and federal PFAS regulations.
  • Representation of various trade groups participating as amicus in a Supreme Court CERCLA case.
