Jana Seidl is an associate in the Antitrust and Competition Practice Group, who focuses on private and government litigation, investigations, mergers, and antitrust counseling. Jana defends clients in bet-the-company antitrust cases, including competitor actions, large class actions and multidistrict litigations, alleging anticompetitive conduct such as group boycotts, price fixing, bid rigging, monopolization, and exclusive dealing. Her practice also includes merger review counseling and advocacy before the U.S. antitrust agencies and international competition law regimes, as well as counseling clients on pricing and distribution policies, antitrust compliance trainings, and internal and government competition-related investigations.

Jana also maintains a robust pro bono practice, representing individuals in litigation related to exoneration and compensation for the wrongly convicted.

During law school, Ms. Seidl interned with the Honorable Jimmie V. Reyna of the United States Court of Appeals for the Federal Circuit and the Honorable Rudolph Contreras of the United States District Court for the District of Columbia.

  • In re Generic Pharmaceuticals Pricing Antitrust Litigation – Representing pharmaceutical defendants as counsel in massive MDL litigation brought by state attorneys general, individual, direct action plaintiffs, and putative classes of direct, intermediate, and end purchaser plaintiffs.
  • PharmacyChecker.com v. National Association of Boards of Pharmacy, et al. – Counsel representing the National Association of Boards of Pharmacy in defense of Sherman Act Section 1 conspiracy claim and false advertising claim under the Lanham Act.
  • Patterson Companies, Inc. – Trial counsel for Patterson Companies, Inc. in several federal court cases accusing the company of conspiring with its primary rivals to fix prices and boycott ‘buying groups’. The Baker Botts team was granted favorable settlements in two separate competitor boycott cases (SourceOne and IQ Dental, E.D.N.Y.), and resolved an FTC lawsuit, after an eight-week administrative trial, with no monetary penalty or independent monitor.
  • New Prime v. Eaton Corporation – Represented defendant in action brought by an indirect purchaser in federal court in Missouri alleging monopolization, exclusionary conduct, fraud, unfair competition, and unjust enrichment. Granted full dismissal of complaint at motion to dismiss stage.
  • In re Ductile Iron Pipe Fittings Antitrust Litigation – Represented McWane, Inc. in price fixing and monopolization class actions brought by direct and indirect purchasers and received favorable settlement after aggressive merits and class defense.
  • In re Cast Iron Soil Pipe and Fittings Antitrust Litigation – Represented McWane, Inc. in direct and indirect purchaser price fixing class actions and granted favorable settlement after aggressive merits and class defense.

  • Representing large technology company in an FTC study on non-reportable acquisitions.
  • PepsiCo, Inc. – Represented PepsiCo, Inc. in its acquisition of Popcorners and other brands from BFY Foods, Inc.
  • Ingevity Corporation – Represented Ingevity Corporation in its acquisition of Georgia-Pacific's pine chemicals business for $315 million.
  • American Industrial Partners – Represented AIP, a leading mid-market private equity fund, in several transactions, including ACProducts’ acquisition of Masco’s kitchen cabinetry business valued at $1 billion, and the combination of the Goss International and Manroland Web Systems printing press businesses.
  • PetIQ, Inc. – Represented PetIQ as divestiture buyer of Capstar portfolio from Elanco Animal Health before the FTC.
  • Merck & Co., Inc. – Counseled Merck in connection with its oncology collaboration with Eisai Co., Ltd.
