WASHINGTON, May 5, 2015 - Baker Botts, a leading international law firm, announced today that the firm was awarded the Global Competition Review’s (GCR) Award for "Behavioral Matter of the Year - Americas" for its defense of McWane, Inc. in a wide-ranging antitrust case brought by the Federal Trade Commission (“FTC”).
In 2011, the FTC opened an investigation of McWane to determine whether certain practices related to McWane’s soil pipe business may have violated Section 5 of the Federal Trade Commission Act.
Following an eight-week trial led by partner Joseph Ostoyich, the FTC’s Administrative Law Judge rejected the agency’s claims of a price fixing conspiracy in their entirety.
The full Commission subsequently dismissed six of seven conspiracy and monopolization charges. The dismissals marked the first time in nearly two decades that the Commission ruled against itself following an administrative trial in its in-house court.

Baker Botts’ defense of McWane against the FTC was one of four nominees for “Behavioral Matter of the Year - Americas” - which awards cases that focused on creative, strategic and innovative work carried out in a behavioral matter on behalf of a defendant, a competition authority or a third party in the Americas.
