Lindsay Volpenhein Cutié

Lindsay Volpenhein Cutié practices in all areas of intellectual property law, including patent litigation, patent prosecution, and various aspects of intellectual property transactions.

Ms. Cutié’s litigation experience has involved a variety of technologies, including telecommunications, pharmaceuticals, and oilfield equipment.

Ms. Cutié is licensed to practice before the United States Patent and Trademark Office. She has experience preparing and prosecuting patent applications relating to a broad range of technologies. She also has experience with post-grant procedures, including inter partes reviews, before the Patent Trial and Appeal Board.

Ms. Cutié also has provided formal opinions concerning potential infringement, validity, and enforceability of client and third-party intellectual property across various technologies, including refining, chemical catalysts, chemical formulations, and semiconductors.

Prior to attending law school, Ms. Cutié worked as a process automation engineer for a Fortune 100 chemical company.

• Sprint Communications Company. v. Multiple Defendants (District of Delaware) – Defending five cable companies in a patent cases related to ATM switching and communication technologies
• Gensetix, Inc., Plaintiff, and the Board of Regents of the University of Texas System, Involuntary Plaintiff, v. Baylor College of Medicine, Diakonos Research, Ltd., and William K. Decker. (Southern District of Texas) – Defending Baylor College of Medicine in patent infringement action related to cancer treatment
• CDN Innovations, LLC v. Cable One, Inc. d/b/a Sparklight (Eastern District of Texas) – Defended Cable One in patent infringement action
• Defended generic pharmaceutical companies in Hatch-Waxman litigations filed in the District of New Jersey
• Derrick Corp. v. Axon EP, Inc. and Screen Logix, LLC, (Western District of Louisiana) – Defended Axon EP and Screen Logix and its officers against patent infringement, false advertising, theft of trade secrets, and unfair trade practices claims related to mud screen technology
• Phoenix Licensing v. Cequel (Eastern District of Texas) – Defended Cequel (Suddenlink) in a patent infringement action concerning direct marketing systems

Patent Post-Grant Proceedings

• Represented Axon EP, Inc. and Screen Logix, LLC in filing IPR proceedings related to challenges to patents covering mud screen technology

Arbitration

• Represented African energy company in ICDR arbitration regarding $500 million dispute regarding construction of small-scale LNG liquefaction facilities
• Represented a U.S. chemical company in an arbitration with a counterparty in license agreement for chemical catalysts

Transactional

• File, prosecute and maintain patent applications for various companies over a wide range of chemical and mechanical technologies, including distillation and gas flaring
• Prepared freedom to operate analyses and patent opinions for several chemical companies, including one opinion related to gas to liquids refining process
• Represented a number of companies in the energy industry in connection with their acquisition and licensing of intellectual property assets
