Baker Botts Wins ITC Exclusion Order for FUJIFILM in High-Profile Case Against Sony

WASHINGTON, D.C., March 20, 2018 - Baker Botts L.L.P., a leading international law firm, announced another victory for firm client FUJIFILM Corporation and its affiliates in a high-profile case against Sony Corporation at the U.S. International Trade Commission (ITC), related to high density magnetic storage media cartridges. On Friday, March 9, the full Commission ruled in favor of Fujifilm and awarded an exclusion order against Sony’s magnetic tape data storage cartridges, including Sony’s seventh generation (“LTO-7”) products.

The firm “is very pleased with the Commission’s decision to issue orders excluding and enjoining Sony’s infringing products, and we are grateful for the hard work, commitment and amazing support we’ve received from our long-standing client Fujifilm in connection with this ongoing dispute.”

The Commission’s decision comes just weeks after Baker Botts secured a victory for Fujifilm in an ITC countersuit, brought by Sony, on related tape media technologies. There, after a trial held in September, ITC Chief Administrative Law Judge Bullock found in an Initial Determination that Fujifilm had not violated Section 337 with regard to any of the Sony patents asserted against Fujifilm.

Baker Botts is among the most active general-practice patent litigation firms in the U.S., and in the past year has been counsel in at least six ITC investigations. The firm’s patent litigation docket includes more than 150 current patent cases in district courts, the ITC, and the Federal Circuit. Baker Botts’ PTAB Trials practice, working strategically with litigation teams, has handled over 300 matters at the Patent Trial and Appeal Board on behalf of clients, including in connection with the Fujifilm-Sony dispute.

The cross-office Baker Botts trial teams in the Fujifilm matters included Rob Scheinfeld, Rob Maier, Jennifer Tempesta, Neil Sirota, Paul Ragusa, Eric Faragi, Mike Knierim, Joe Akalski, Jessica Lin, Margaret Welsh, Al Boardman, Frank Zhu, and Xanadu Halkias (NY); Lisa Kattan, Tommy Martin, and Lauren Dreyer (DC); and Syed Fareed (AUS). Other Baker Botts lawyers are also assisting on two other related ITC investigations set for hearing in the coming months, and related patent office and district court proceedings.
