IP Lawyers to Comment on SCOTUS Ruling in TC Heartland, Patent Venue Impact

Media Alert
WASHINGTON, D.C., May 2, 2017 – Baker Botts’ Intellectual Property (IP) lawyers are tracking TC Heartland v. Kraft Foods Group Brands, a case considered one of the most significant patent cases awaiting decision at the U.S. Supreme Court as it concerns the proper reading of the term “resides” in the patent venue statute. The Court will be deciding whether to revert to a prior, more stringent venue standard, which would limit venue in patent cases to districts where defendants are incorporated or have an established place of business.

Baker Botts patent lawyers in California, New York, and Texas will be available the day of the Court’s decision to address what effect the outcome has on venue reform for patent infringement litigation in the United States. Partners Harper Batts, Michael Hawes, Robert Maier, Neil Sirota, and Wayne Stacy can address how the decision may impact:

  • The Eastern District of Texas, District of Delaware and/or Northern District of California;
  • Product companies versus service companies;
  • Web sales versus brick and mortar sales;
  • Intervention by manufacturers in lawsuits against local retailers;
  • The Supreme Court’s view of the Federal Circuit;
  • Foreign companies versus U.S. companies; and
  • Unincorporated entities versus corporations.
