NLJ Features Baker Botts on Growing Supreme Court Presence



HOUSTON, August 19, 2014 -- According to editors at The National Law Journal, “Baker Botts is back before the high court in a significant way.”

The publication highlights Litigation partner and chairman of the Supreme Court and constitutional law practice, Aaron Streett, mentioning “In the firm’s push for hard-to-get Supreme Court work, Streett is not going it alone.” The article also recognizes David Sterling, chairman of the firm-wide litigation practice; Evan Young, formerly a clerk to Justice Antonin Scalia; and associate Michelle Stratton, a 2011 clerk for Justice Clarence Thomas, who has just gotten past the two-year prohibition against Supreme Court work for former clerks.

“We have the foundations of a very good Supreme Court team,” Streett said.

The article also highlights that “Streett’s first argument was in the closely-watched Halliburton Co. v. Erica P. John Fund, a key case in the field of securities class actions.” The “plaintiffs averted disaster,” Streett said, but “defendants are significantly better off” than before in battling class actions—they now can offer evidence at the certification stage rebutting the presumption under Basic that a company’s misstatements affected stock prices.

Further, the article notes “In Baker Botts v. ASARCO, Streett is asking the justices to review a ruling by the U.S. Court of Appeals for the Fifth Circuit that barred law firms in bankruptcy cases from being awarded fees for defending a fee application.”

“With a clear circuit split on the issue, Streett thinks the chances are good the high court will take up the case next term.”
