NEW YORK, June 29, 2012 -- Shortly before the start of the jury trial in Liberty Media Corp’s decade-old contract suit against Vivendi Universal SA, the judge overseeing the case forced Vivendi to stipulate to certain unflattering facts.

That ruling was a double-edge sword for Liberty’s lawyer, Baker Botts L.L.P. Partner Michael Calhoon. It helped prove his case, but also complicated the narrative of deceit by Vivendi that he hoped to present to the jury.

And if he dwelled on stipulated facts, his opposing counsel would accuse him of trying to distract jurors from the issues left in the case.

Mike developed a strategy that let him both focus on the remaining legal issues, but also draw on stipulated facts that undermined Vivendi’s credibility. The balancing act paid off in a big way on Monday, in the form of a $956 million verdict for Liberty in U.S. district court in Manhattan.
