Jury Awards More Than $35 Million in Damages to Halliburton in Patent Infringement Lawsuit Against Weatherford International



DALLAS, February 24, 2012 -- A Dallas federal court jury unanimously found Weatherford International, Inc. liable for infringing on Halliburton Energy Services Inc.’s ground-breaking Patent related to drillable composite plugs used in underground drilling operations following an eight-day trial and two days of deliberations that ended on February 17, 2012. The jury awarded Halliburton damages of more than $35 million.

Halliburton’s patented technology has been instrumental in the development of horizontal drilling, hydraulic fracturing technologies and natural gas production from shale plays during the past decade.

Baker Botts was hired by Halliburton to handle the patent infringement lawsuit against Weatherford in 2007. At trial, Weatherford contested both the validity and infringement of the Patent (styled United States Patent No. 5,224,540).

The jury found the asserted independent claim and three dependent claims of Halliburton’s Patent to be valid and further found that Weatherford had infringed all asserted claims of the Patent.

The case style is Halliburton Energy Services Inc. v. Weatherford International Inc. (Civil Action No. 3:10-cv-02595-N), which was severed in 2010 from a case styled Halliburton Energy Services Inc. v. Weatherford International Inc. et al (Civil Action No. 3:07-cv-02144-N).
