NEW YORK, July 6, 2011 -- In a recent posting to the New York Law360 web site, editors asked Baker Botts Partner Seth Taube to describe an important lesson learned early in his legal career. Taube, whose practice focuses on commercial and securities litigation, responded by relating an experience concerning an expert witness at a trial soon after he joined the firm.

For this trial, Taube hired an expert “who was superb in his field and was correct in his analysis but could not testify in a clear and understandable manner.”

“I learned from that experience that a witness’s manner and simplicity of expression are as critical as truthful or important testimony,” Taube says. “In essence, ‘the medium is the message’ when it comes to trial witnesses.”
