Baker Botts and BIICL Launch the Second Annulment Project on Annulment in Investor-State Arbitration
Join Baker Botts and British Institute of International and Comparative Law (BIICL) on Wednesday 15 October 2025 as we present the findings from our world-first comparative study of ICSID and non-ICSID annulment proceedings, a sequel to our groundbreaking 2021 study on annulment in ICSID arbitration.
This study reviews 170 non-ICSID annulment proceedings across 16 jurisdictions and over 230 ICSID annulment proceedings. It shows that national courts annulled awards at a significantly higher rate than ad hoc committees in ICSID annulment proceedings. Not only that, but the rate of success in some key jurisdictions is increasing. These trends can be attributed to several factors, including the broader jurisdictional review available under national laws and the option to invoke public policy objections.
Following a presentation of the findings in the study, the distinguished panel of speakers below will share their thoughts on the future of ICSID and non-ICSID annulment. The event will be followed by a reception.
