Legal Implications of the Kennedy Assassination

At precisely 12:30 pm on November 22, 1963, President John F. Kennedy was in a jet blue limousine riding through downtown Dallas, Texas, sitting next to the First Lady and behind the governor of Texas and his wife, when he was shot. By 1 pm, having been rushed to Parkland Hospital, the President was declared dead. Less than an hour later, at about 1:50 pm, Lee Harvey Oswald was arrested at the Texas Theater. Within an hour and 20 minutes, the Dallas Police had solved the most grievous American crime of the 20th Century and had the assassin in custody. Or had they? No trial occurred because within 2 days, the alleged assassin would be himself shot dead in the basement of the Dallas Police Department.

Although it is the greatest unsolved murder mystery in history, no one has analyzed the assassination of President John F. Kennedy from a pure legal perspective. With the release of documents that have been withheld for 70 years, that time is now.

In this presentation, Baker Botts partner Matt Jacobs will analyze the case from a legal perspective and assess (i) motive and opportunity; (ii) the credibility of the investigation in the aftermath of Oswald’s death, including ethical issues in the handling of evidence and the treatment of several key female witnesses; (iii) the forensic evidence and what it says about Oswald’s guilt; (iv) Oswald’s intelligence connections and what it tells us about whether he acted alone; and (vi) draw conclusions about what really happened.
