Historically, the Antitrust Division and the Federal Trade Commission have civilly enforced prohibitions against employee wage-fixing and “no poaching” agreements. However, in doing so, the Antitrust Division and the Federal Trade Commission warned that in the future it would criminally prosecute agreements among competitors that fix wages or enter into no-poach agreements. The Antitrust Division is now getting ready to announce no-poach cases it is criminally prosecuting. This is a major development with significant ramifications for companies. The Antitrust Division is now signaling that the era of civil enforcement of such agreements is over.
