Latest USPTO Issued Guidance on Inventions Involving AI and Subject Matter Eligibility
The USPTO recently issued guidance on the subject-matter eligibility of inventions which include artificial intelligence. The Guidance provides an explanation of the various patent-ineligible subject matter categories, takes note of the evolving caselaw and three examples of AI-inventions involving AI that are eligible under the current framework. This article provides an overview of the Guidance as well as some key takeaways which may be useful in protecting (and even asserting) AI inventions in the future.
