Overview

Kristina Vu has handled complex commercial matters in court and arbitration and has worked on large-scale cases, such as class action lawsuits and multidistrict litigation. Kristina has experience in nuisance lawsuits, oil and gas upstream lease disputes, oil and gas implied development disputes, complex contract disputes, landlord-tenant disputes, trade secret disputes, and tort lawsuits. 

Kristina also has experience advising clients prior to initiation of any litigation. In this advisory role, Kristina has helped clients assess their potential liability exposure and the strength of each parties' claims and defenses. Kristina has also aided in conducting litigation-related due diligence for potential large-scale transactions.

Pro bono work is an important part of Kristina's practice. She has served as the lead attorney on pro bono cases including landlord-tenant disputes and breach of contract disputes. She has also represented clients in asylum and T visa cases. As part of her pro bono practice, Kristina has tried both bench and jury trials, negotiated cases with opposing counsel, and led case management and strategy.

Prior to joining Baker Botts, Kristina worked as a student attorney at the Harvard Legal Aid Bureau. In this role, she represented clients at hearings, managed cases as the lead attorney, determined legal strategy, and led negotiations with opposing counsel. Kristina also led the disability benefits practice while working at the Harvard Legal Aid Bureau.

Kristina is an active member of the Houston legal community. She has served on the Houston Bar Association's Diversity & Inclusion Committee and Community in Schools Committee.  She has also served on the Public Statements Committee, on the Gala Committee, and as Secretary of the Asian American Bar Association of Houston. She is also a Texas Bar Foundation Fellow and a participant in the Institute of Energy Law’s 7th Leadership Class.

Energy Litigation

  • Obtained a beneficial summary judgment ruling for a leading renewable energy company in a nuisance lawsuit relating to the client’s solar farm (Martin v. Hopkins Energy, LLC, No. 06-21-00070-CV, 2021 WL 4527904 (Tex. App.—Texarkana Oct. 5, 2021, no pet.))
  • Represented oil and gas operators in lawsuits involving implied covenant to develop claims
  • Represented lessees in oil and gas contract disputes
  • Provided pre-litigation analysis of oil and gas lease issues, including but not limited to temporary cessation of production doctrine, Pugh clauses, unit designations, habendum provisions, and anti-dilution provisions
  • Obtained a voluntary dismissal for a Fortune 500 energy company in an arbitration involving hundreds of title disputes amounting to half a billion dollars’ worth of claims
  • Obtained summary judgment ruling in favor of Fortune 500 pipeline energy company in lawsuit seeking to enjoin the construction of a $2 billion natural gas pipeline (Sansom, et al. v. Texas Railroad Commission, et al., 2019 WL 13120549, in the 345th Judicial District Court of Travis County (Judge Lora J. Livingston))
  • Assisted energy clients with responding to Attorney Generals’ Civil Investigative Demands pertaining to Winter Storm Uri

  • Analyzed construction contract and provided legal advice to Fortune 100 energy company
  • Obtained temporary restraining order for biotechnology client in a lease dispute and negotiated a favorable resolution for client
  • Represented producer of products derived from petrochemical raw materials in mass torts multi-district litigation following a plant explosion
