Overview

Emily Deer is dedicated to helping clients navigate through all phases of complex, high-stakes patent litigation in U.S. district courts, with an emphasis on litigation in the popular patent courts of the Eastern and Western Districts of Texas. She has gained stand-up motion, jury trial, and bench trial experience by litigating over fifteen Texas patent cases in just five years. In particular, Emily has extensive experience in the Eastern District of Texas, and she is well-versed in--and passionate about--developing discovery, motion, claim construction, and trial strategy in that venue. Emily's peers selected her for recognition in the 2026 edition of Best Lawyers: Ones to Watch® in America for Intellectual Property Litigation, Patent Litigation, and Patent Law.

Emily has been the lead associate on jury trial teams for both the plaintiff and defense sides in Texas district court. She also has argued at Markman hearings, dispositive motion hearings (e.g., for Section 101 ineligibility), discovery hearings, and pre-trial conference and has briefed a wide variety of legal issues in district courts across the country. Emily's litigation experience covers a diverse array of technologies, including wired and wireless telecommunications, video technology, location technology, containerization technology, medical devices, and flight control systems for both manned and unmanned aerial vehicles.

In addition to patent litigation, Emily has experience drafting and prosecuting patent applications related to telecommunications, medical devices, aerospace, HVAC, software, electronic hardware, and the mechanical arts. She also maintains an active pro bono docket, which includes assisting pro bono clients in addressing IP issues and preparing trademark applications, and she is currently serving her second year on the Leadership Council of the Junior League of Dallas.
