Overview

Amy Bergeron practices in all areas of intellectual property law. She has significant experience in patent litigation and other intellectual property matters involving a variety of technologies, including mechanical and electrical devices. Ms. Bergeron is an experienced trial attorney, having been a member of trial teams in Texas state court, federal court and the International Trade Commission.

Ms. Bergeron has experience in patent and trade secret litigation, counseling, and licensing. With respect to patent litigation, Ms. Bergeron's broad experience includes matters involving a variety of technologies, including telecommunications, chemicals, public safety systems, and oilfield equipment. Ms. Bergeron has also litigated several major trade secret cases involving oilfield equipment and telecommunications.

Ms. Bergeron is licensed to practice before the United States Patent and Trademark Office. She has experience preparing and prosecuting patent applications relating to a broad range of technologies, including a variety of chemical, biological, mechanical, and electrical technologies. She also has significant experience with post-grant procedures, including inter partes reviews, before the Patent Trial and Appeal Board.

Experience

  • STA Group v. Motorola Solutions (E.D. Tex.) – Representing Motorola in ongoing patent infringement and trade secret misappropriation case
  • Utex Industries, Inc. v. Troy E. Wiegand and Garner Denver (S.D. Tex.) – Represented plaintiff Utex in a patent infringement, trade secret misappropriation, breach of contract and tortious interference with contract dispute against a former employee and his new employer. The case involves specialized seals for fracturing pumps used in the oil and gas field
  • Sprint Communications Company. v. Multiple Defendants (D. Del.) – Defending five cable companies in a patent cases related to ATM switching and communication technologies
  • FMC Technologies, Inc. v. Richard Murphy and Dril-Quip, Inc. (Harris County District Court, 127th Judicial District) – Trial counsel for Dril-Quip in a month-long jury trial during the pandemic. The case involved a claim for misappropriation of trade secrets against Dril-Quip and a former FMC employee hired by Dril-Quip. The jury returned a verdict in favor of Dril-Quip and the former FMC employee finding that none of the alleged information misappropriated were trade secrets.
