SAN FRANCISCO, October 4, 2017 – Baker Botts’ Intellectual Property lawyers comment on the Federal Circuit Court of Appeals’ decision today in Aqua Products, Inc. v. Matal, a case challenging the Patent Trial and Appeal Board’s (PTAB) rules for amending patent claims in America Invents Act (AIA) reviews.
Baker Botts patent partners Wayne Stacy, Sarah Guske and Eliot Williams have been closely tracking the case and are available to comment on the Court’s ruling – a decision which presents two separate issues. It impacts the PTAB, but more significantly, the decision will affect the IPR process and may significantly increase the number of those proceedings where proposed amendments are presented by the patent owner.
