Baker Botts Lawyers Comment on U.S. Supreme Court Decision on SEC Disgorgement Orders

Media Alert
WASHINGTON, D.C., June 5, 2017 - The U.S. Supreme Court held in a unanimous decision today, Monday, June 5, 2017, that disgorgement collected by the U.S. Securities and Exchange Commission (SEC) is subject to the five-year statute of limitations on civil penalties.

Baker Botts investigations partners Brad Bennett, Bridget Moore and Jonathan Shapiro are available to speak on the Court’s decision that resolves a circuit split in disgorgement orders, which require those found to have violated securities laws to surrender ill-gotten gains. They can discuss:
  • Whether the decision raises questions as to the viability of the disgorgement remedy going forward
  • Reasoning behind the Court’s ruling
  • Takeaways from the fact that the ruling was 9-0 and issued so quickly after the case was submitted
  • Practical effect of the ruling on the SEC’s Enforcement efforts going forward
