HOUSTON, November 18, 2014 -- Baker Botts’ Appellate practice continues to gain recognition by being named to the National Law Journal’s prestigious 2014 Appellate Hot List.
In the firm’s profile, author Sheri Qualters wrote, “The appellate team’s ties to the energy industry translate into all kinds of big appeals for Baker Botts’ clients, even in unrelated disciplines like securities and bankruptcy law.”
Qualters focused on examples that represented the bulk of Baker Botts’ Appellate work through the past year -- from the Supreme Court case of Halliburton v. Erica P. John Fund, to the landmark Fifth Circuit decisions in Aransas Project v. Shaw (involving the Endangered Species Act) and In re ASARCO LLC (involving bankruptcy attorney fees), which Baker Botts will argue before the U.S. Supreme Court in early 2015.
In Halliburton v. Erica P. John Fund, the firm, representing Halliburton Co., secured a ruling that allows defendants to present evidence at the class-certification stage to counter the presumption that misstatements affected share price.
Baker Botts excels at “attention to detail and their intimate knowledge of the underlying facts of the matter,” said Robb Voyles, Halliburton’s general counsel. “They spend the time to understand the facts and the record and the case.”
In April, the Fifth Circuit agreed the firm deserved a $4.1 million bonus for exceptional performance and results on top of $113 million in fees that it earned in the highly successful In re ASARCO LLC bankruptcy. The Fifth Circuit wrote that the firm likely secured the largest fraudulent-transfer judgment in bankruptcy history.
“We have such a historical relationship with the energy industry,” said Baker Botts Litigation partner and chairman of the firm’s U.S. Supreme Court and constitutional law practice, Aaron Streett. “We get hired when something really has gone south at trial.”
In the feature, the National Law Journal identified 20 firms with outstanding achievements before the U.S. Supreme Court, federal circuit courts and state courts of last resort.
