Energy regulatory matters, particularly with respect to infrastructure development and related appellate litigation

Summary

Adam White's law practice incorporates regulatory matters specific to the energy industry, with a particular focus on appellate litigation and motions practice.

Following graduation from law school, Mr. White served as a law clerk to the Honorable David Sentelle of the United States Court of Appeals for the District of Columbia Circuit.

Mr. White is Vice Chairman of the Energy Bar Association's Judicial Review Committee.  He also is Co-Chairman of the Federalist Society's Administrative Law practice group, Judicial Review subcommittee.

Representative Engagements

  • Hess LNG – co-authored briefs and assisted at oral argument in a variety of controversies, including appeals before the U.S. Court of Appeals for the District of Columbia Circuit and for the First Circuit (involving, e.g., the National Environmental Policy Act and the Clean Water Act), and other proceedings before federal and state agencies.  Secured First Circuit ruling that Rhode Island's "public trust" powers were preempted by federal law, as applied to LNG project 
  • Foundation for the Defense of Democracies – Counsel of record for Supreme Court amicus brief supporting Government in Guantanamo Bay detention litigation
  • Global power company – co-authored briefs in multiple proceedings in the U.S. Court of Appeals for the Fourth Circuit and U.S. District Court for the District of Maryland (regarding constitutional limitations on state efforts to block energy infrastructure development); contributed to advocacy, before federal and state agencies 
  • The Campbell Group, et al. – representation of amici curiae in Supreme Court litigation regarding alleged predatory practices in violation of federal antitrust law
  • Reliant Energy Power Generation – co-authored briefs in the U.S. District Court for the District of Columbia, challenging FERC's response to FOIA requests
  • Miscellaneous other filings in various federal courts of appeals, federal agencies
  • Pro Bono – authored briefs in federal courts of appeals regarding criminal sentencing, First amendment issues; co-authored and co-designed an exhibit on the history of the federal courts of the D.C. Circuit on behalf of the D.C. Circuit Historical Society
