Consumer Products

Baker Botts lawyers who routinely work for consumer products were described in The Legal 500 this way: “The group’s lawyers ‘have a focus on what really matters and are really efficient’.”

Our lawyers have substantial experience in a wide variety of consumer products issues. We handle consumer class actions in state and federal courts all around the United States.

Baker Botts lawyers have served as:

  • lead defense counsel for a multinational beverage company in obesity and school vending litigation
  • lead defense counsel on advertising and consumer products litigation, including product ingredients and labeling
  • plaintiff counsel in antitrust and tortious interference claims against competitors

Our lawyers handle cases involving a variety of consumer and industrial products, including building products, automotive, tire, construction equipment, aircraft, watercraft, beverages, food and infant formula products, and pharmaceutical and medical devices, among others.

We also counsel clients in their dealings with the Consumer Products Safety Commission and other regulatory agencies. We defend consumer class actions involving allegations under consumer protection and deceptive trade practices statutes and for claims of fraud, antitrust and trade liability, fraud and securities fraud, breach of contracts and warranties, and employee compensation and discrimination.

Consumer product companies also seek us out for large scale M&A transactions, securities law advice, and corporate governance and compliance. For example, we served as lead counsel in a billion dollar debt offering for a leading consumer products company. We have helped negotiate leases for company headquarters, as well as financing for manufacturing facilities factories.

We act as principal counsel in a number of high-profile finance projects affecting consumer goods. For example, we served as legal counsel in financing the Petroterminal de Panama, a new terminal which provides a cheaper transit alternative for goods transported on ships that are too large to fit through the Panama Canal. Project Finance awarded this project its 2009 “Latin American Refinancing Deal of the Year” and commented that it is “the largest private project financing ever in Central America.”

We have a deep understanding of the industries we serve and that knowledge provides us with the ability to deliver better solutions.
