Baker Botts boasts a nationally renowned trademark practice comprising more than 10 full-time trademark lawyers who handle all aspects of trademark law and related issues. We have developed successful strategies for managing trademark and trade dress rights consistent with clients' short- and long-term business plans. Our lawyers effect and oversee clearance, registration, protection and enforcement for a large and diverse group of clients based both in the U.S. and abroad.

Working with an established network of foreign associates in more than 150 countries, we provide our clients with efficient and cost-effective global trademark protection. Our lawyers also have broad experience negotiating and drafting trademark licenses, co-existence agreements and co-branding agreements, and we conduct due diligence investigations of trademark assets for corporate transactions.

In addition, our trademark lawyers handle a broad range of other matters that relate to intellectual property assets, including domain name issues, UDRP actions, Internet law, e-commerce, cybersquatting, anticounterfeiting actions, computer game and technology licensing, marketing and distribution relationships, advertising, sweepstakes and entertainment law. Baker Botts also has considerable experience in litigation, including bench and jury trials, defending and prosecuting trademark, trade dress, unfair competition, false advertising and trade secret claims. Our lawyers are able to offer sophisticated counseling and litigation services in the subcategories of Internet and trademark law involving metatags, pop-up advertisements, phishing and related issues.

Copyright matters also form a significant part of our work. Our lawyers have substantial experience in copyright in such varied industries as toys, artwork, cartoon characters, fabric and knitwear designs, fashion accessories, architectural design, musical recordings, literary works, and advertising and packaging materials. We advise clients on a wide range of copyright matters, including infringement, renewals, termination of transfers and other issues affected by the ever-changing copyright laws. Our lawyers prepare and prosecute copyright registrations, and negotiate and draft development, licensing, publishing and other agreements.

Additionally, the diverse skills and scientific backgrounds of our intellectual property lawyers, a number of whom have engineering and computer science degrees, add to our experience in the area of copyright protection for scientific material. Our lawyers effectively manage the protection and licensing of computer-related technology, including source code and executable programs along with the associated instruction and operating manuals. As a group we have a long and extensive history of litigating and trying all types of copyright cases. Baker Botts has also been the reviser of the Copyright Law Digest for the Martindale-Hubbell legal directory since 1978.
