Baker Botts tax lawyers are particularly experienced in transactions in the energy and power sectors. We regularly advise clients in every facet of the industry, including regulated and unregulated electric and gas utility companies, wind developers and producers, energy trading companies, energy services companies, drilling companies, and oil and gas companies (upstream, downstream, and exploration and production).

Our lawyers have provided tax counsel on numerous debt and equity offerings of companies in the energy and power industry. We have advised these companies with tax issues incident to mergers and acquisitions and to their international transactions. We have structured and negotiated effective leasing structures in connection with power plant development. We also have extensive experience with Section 45 wind power tax credit planning and monetization transactions.

Baker Botts tax lawyers have been particularly active in representing electric utility companies before, during and after deregulation. We have significant experience in tax issues relevant to regulated utilities, including normalization issues that have arisen before public utility commissions. Further, we are well versed in the tax requirements incident to being a regulated company under the 1935 Act. We have also been actively involved in tax issues relating to Section 118 contributions in aid of construction issues.
